By downloading, installing, or using the App, you ("the User") agree to be bound by the following terms and conditions. 1. Acceptance of Terms
By accessing or using Libkis, you confirm that you have read, understood, and agreed to comply with all the provisions of this User Agreement. This Agreement constitutes a binding contract between you and the App provider. The App provider reserves the right to modify, update, or revise these terms at any time. Any changes will be effective immediately upon posting within the App or on the official communication channels. Your continued use of the App after such changes constitutes your acceptance of the updated Agreement.
2. Eligibility
You must be at least 13 years of age to use Libkis. By using the App, you warrant that you meet this age requirement and have the legal capacity to enter into this Agreement. If you are using the App on behalf of a minor (with appropriate parental or guardian consent), you assume full responsibility for their compliance with these terms and any actions taken through the App.
3. App Usage Rights
3.1 License Grant: The App provider grants you a non-exclusive, non-transferable, revocable license to use Libkis solely for personal, non-commercial purposes. You may not use the App for any commercial, professional, or business-related activities without obtaining prior written permission from the App provider.
3.2 Permitted Use: You may use the App's features—including AI-powered scene detection, one-click enhancement, filter presets, professional adjustments (denoising, sharpening, etc.), and real-time previews—in accordance with this Agreement. You agree to use the App only for legal and ethical purposes, and in compliance with all applicable guidelines and standards.
3.3 Restricted Activities: You shall not:
- Modify, alter, reverse-engineer, decompile, disassemble, or attempt to extract the source code of the App or any of its components;
- Copy, distribute, sublicense, rent, lease, or sell the App or its features to any third party;
- Use the App to process or enhance images that violate the rights of others (including copyright, trademark, privacy, or publicity rights);
- Upload or process images that contain illegal, harmful, offensive, violent, discriminatory, or inappropriate content (including but not limited to explicit material, hate speech, or content that promotes harm to others);
- Use the App in a way that disrupts, impairs, or interferes with the App's functionality, servers, or other users' experience;
- Use automated tools, bots, or scripts to access or interact with the App without explicit permission.
4. User Content
4.1 Ownership of User Content: You retain full ownership of all photos, images, and other content ("User Content") that you upload, process, or enhance using Libkis. The App provider does not claim any ownership rights to your User Content.
4.2 License to Use User Content: By uploading or processing User Content through the App, you grant the App provider a limited, non-exclusive, royalty-free license to use, process, and store your User Content solely for the purpose of providing the App's features (e.g., AI enhancement, real-time previews, and saving edited images). This license is necessary to enable the App to function as intended and will terminate once you stop using the App or delete your User Content.
4.3 Responsibility for User Content: You are solely responsible for your User Content and the consequences of uploading, sharing, or distributing it. You warrant that you have the right to upload and use all User Content in connection with the App, and that your User Content does not infringe on any third-party rights, violate any laws, or cause harm to others. The App provider reserves the right to remove or disable access to any User Content that violates this Agreement or is deemed inappropriate, without prior notice.
5. App Features and Functionality
5.1 Feature Availability: The App provider strives to ensure that all features (smart scene detection, one-click enhancement, filter presets, denoising, sharpening, real-time previews, etc.) are available and functioning properly. However, the App provider does not guarantee that all features will be error-free, uninterrupted, or available at all times.
5.2 Updates and Modifications: The App may automatically download and install updates, upgrades, or patches to improve functionality, security, or user experience. You agree to allow these automatic updates, as they may be necessary to maintain the App's performance and security.
5.3 Limitations: The App's AI-powered enhancement features are based on current technology and may not produce perfect results for all images. The App provider does not guarantee that the edited images will meet your specific expectations or requirements. You acknowledge that factors such as image quality, lighting, and subject matter may affect the outcome of the enhancements.
6. No Account Requirement
Libkis does not require you to create an account or provide personal information to log in or use the App. You can access all features of the App without registering an account. This means you do not need to provide an email address, password, or other personal details to use Libkis, unless you choose to contact the App provider for support or feedback.
7. Support and Feedback
7.1 Support: If you encounter any issues with the App, have questions about its features, or need assistance, you can contact the App provider at bikelibkis417@outlook.com. The App provider will make reasonable efforts to respond to your inquiries in a timely manner, but does not guarantee a specific response time or resolution.
7.2 Feedback: Any feedback, suggestions, ideas, or improvements you provide regarding the App ("Feedback") shall become the property of the App provider. The App provider may use, modify, and implement such Feedback without any obligation to compensate you or seek additional permission.
8. Termination
8.1 The App provider may terminate this Agreement and your access to the App at any time, without prior notice, if you violate any provisions of this Agreement.
8.2 You may terminate this Agreement at any time by uninstalling the App and discontinuing all use of its features.
8.3 Upon termination, all licenses granted to you under this Agreement will immediately cease, and you must stop using the App. The provisions regarding User Content, liability, and intellectual property will survive termination.
9. Intellectual Property
9.1 The App, including all its features, software, code, design, logos, trademarks, and content (excluding User Content), is the exclusive intellectual property of the App provider and is protected by copyright, trademark, and other intellectual property laws.
9.2 You may not use, copy, or reproduce any of the App's intellectual property without the App provider's prior written permission.
10. Disclaimer of Warranties
The App is provided "as is" and "as available" without any warranties of any kind, either express or implied. The App provider disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The App provider does not warrant that the App will be error-free, secure, or uninterrupted, or that any defects will be corrected. You use the App at your own risk.
11. Limitation of Liability
To the maximum extent permitted by applicable law, the App provider shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of the App. This includes damages for loss of data, loss of profits, or any other pecuniary loss, even if the App provider has been advised of the possibility of such damages. The App provider's total liability to you for any claims arising from this Agreement shall not exceed the amount you paid (if any) to download or use the App.
12. Miscellaneous
12.1 This Agreement shall be governed by the principles of good faith and fair dealing.
12.2 If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
12.3 You may not assign or transfer this Agreement or your rights under it to any third party without the App provider's prior written consent. The App provider may assign this Agreement to any third party at its discretion.
12.4 This Agreement constitutes the entire understanding between you and the App provider regarding the use of Libkis, and supersedes all prior or contemporaneous agreements, communications, and understandings (whether oral or written) relating to the subject matter hereof.
